Idaho Digital Privacy Compliance

Idaho Consumer Protection Act (ICPA): We handle all consumer data transparently and refrain from any deceptive or unfair tracking mechanisms in alignment with Idaho Code § 48-601.

Children's Privacy: Our services are intended solely for individuals 18 years of age or older. We do not knowingly collect personal data or mobile numbers from children.

SMS Terms and Conditions

By affirmatively opting into our text messaging program (e.g., checking an un-ticked consent box on our website, submitting your number via an onboarding form, or texting an opt-in keyword), you agree to these SMS Terms and Conditions. ManzerTech uses text messaging to communicate with clients on topics relevant to their relationship with ManzerTech. For example, you may receive updates related to your appointments/visits, support requests and updates related thereto, account, one-time passcode, billing notifications, reminders, and service management. Client information used for text messaging will not be shared for marketing purposes.

PLEASE NOTE: THESE TERMS CONTAIN AN AGREEMENT TO RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION WITHOUT JURY TRIAL AND A CLASS ACTION WAIVER, AS DETAILED IN THE "RESOLVING DISPUTES" SECTION, BELOW.

Prior Express Consent and Scope

When you opt-in to the text messaging program, you provide your express written consent to receive recurring automated promotional, marketing, and transactional text messages (including cart reminders) from ManzerTech at the mobile number provided.

Consenting to receive text messages is completely voluntary and is not a condition of purchase for any goods or services.

Messages may be sent using an automatic telephone dialing system or advanced sequencing technology.

Text Messaging Program Disclaimer

By agreeing to participate in the ManzerTech text messaging program, I understand and accept the risks of sending and receiving information via SMS/MMS. I acknowledge that such electronic communications may not be secure.

Consent to receive text messages is not a condition of any services provided by ManzerTech.

Use of my information for the ManzerTech text messaging program is subject to applicable authorization, ManzerTech's Terms and Conditions, and Digital Privacy Policy. Program usage must comply with the guidelines in Exhibit A.

Examples of text messages include:

• Customer service updates
• Account or billing notifications
• Delivery or scheduling reminders

Program Details, Fees, and Frequency

ManzerTech does not charge for its text messaging program. However, standard message and data rates may apply from your wireless carrier according to your mobile data plan.

Message frequency varies.

Your wireless carrier's Message and Data Rates may apply to SMS correspondence. ManzerTech does not charge for any content; however, downloadable content may incur additional charges from your wireless carrier depending on your selected plan. You are solely responsible for any fees, including web access and/or data or text message charges that may be billed by your wireless carrier based on your individual plan. Please contact your wireless carrier for information about your messaging plan. Your carrier may impose message or charge limitations on your account that are outside of our control. All charges are billed by and payable to your wireless carrier.

You represent that you are the owner, or authorized user of the wireless device and phone number you use to receive the service, and that you are authorized to approve the applicable charges.

Message frequency may vary.

ManzerTech will not be liable for any delays or failures in your receipt of any SMS messages as delivery is subject to effective transmission from your network operator and processing by your mobile device. SMS message services are provided on an as is, as available basis.

Data obtained from you in connection with this SMS service may include your mobile phone number, your carrier's name, and the date, time, and content of your messages and other information that you may provide. As described in ManzerTech's privacy policy, we may use this information to contact you and provide information about ManzerTech's services, or surveys about how we could improve our offerings. Your wireless carrier and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies. We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us with information in connection with the service, you agree to provide accurate, complete, and true information.

ManzerTech is committed to upholding the highest standards of privacy for all personal information collected through our text messaging services. We do not sell, rent, distribute, or trade your personal data to third parties without your explicit consent unless legally required to do so. Any information shared with third parties is exclusively for the purpose of delivering our services to you. We assure you that your data will never be shared with third parties for marketing purposes.

Clear Opt-Out and HELP Instructions

To Unsubscribe/Opt-Out: Reply STOP to any text message you receive from us. You may also reply CANCEL, END, QUIT, or UNSUBSCRIBE. Upon receipt, you will receive a single text confirming that you have been unsubscribed, and we will cease messaging your number.

For Support: Reply HELP to any message, email us at support@manzertech.com or call or text us at (208) 714-4445.

Alternative Opt-Outs: In compliance with federal guidelines, you may also opt out by any other reasonable means, including contacting our customer support line. Requests are processed within 10 business days.

You represent that you are the subscriber for or authorized user of the mobile telephone number that you provided to ManzerTech and that you are authorized to approve any related charges for messaging and data applied by your wireless carrier.

Quiet Hours and Delivery

To respect your privacy, automated marketing text messages will only be broadcast between 8:00 AM and 9:00 PM local time based on your area code or known location. We are not responsible for delayed or undelivered messages caused by carrier network issues.

Resolving Disputes

PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

In the event that there is a dispute between you and ManzerTech relating to ManzerTech text messaging communications, arising out of any matter, including in connection with any federal or state statutory provision or the determination of the scope or applicability of this Agreement to arbitrate, such dispute will be resolved by arbitration in Idaho before one arbitrator. The arbitration will be administered by the American Arbitration Association (AAA). The arbitrator will apply the substantive law of the State of Idaho, exclusive of its choice of law rules. To the fullest extent permitted by law, each of the parties agrees that any proceeding will be conducted only on an individual basis and not in a class, consolidated or representative action. The decision of the arbitrator will be final and binding on the parties and will not be subject to appeal or review. If for any reason a dispute proceeds in court rather than through arbitration, each party knowingly and irrevocably waives any right to trial by jury. The arbitrator will deliver a reasoned written decision with respect to the dispute. The parties acknowledge that this agreement evidences a transaction involving interstate commerce. Notwithstanding the provision in this paragraph with respect to applicable substantive law, this arbitration agreement will be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1, et seq.

Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary.
